Terms of Service

Welcome to SkillBasedMatching, operated by SkillPatron Corporation. These Terms of Service ("Terms") govern your use of our fully managed job search and Right-to-Represent (RTR) services. By accessing or using our services, you agree to be bound by these Terms.

1. Service Overview and Guarantee Disclaimer

• SkillBasedMatching provides a combined Right-to-Represent (RTR) and Job Application service to execute your job search, including profile optimization, high-volume application submission, and strategic networking on your behalf.
• You understand and agree that neither SkillBasedMatching nor its affiliates guarantee employment.
• The typical timeframe to secure a job offer through our RTR service averages between 1 to 4 months. Federal or executive-level jobs may take longer due to typically longer, more involved hiring cycles.
• Clients with reasonable expectations typically get hired within 2 months.

2. Client Authorization and Responsibilities

• Right to Represent (RTR): By signing up for the service, you authorize SkillBasedMatching to act as your RTR. We will apply for jobs, communicate with recruiters, and conduct strategic networking on your behalf.
• Application Approval: We apply for jobs only after you have reviewed and approved the specific positions based on criteria including locations, compensation, required skills, and work-life balance considerations.
• Dedicated Email: You must provide or allow SkillBasedMatching to create a dedicated email account used solely for your job search.
• Profile Maintenance: You agree to maintain an accurate and up-to-date resume and LinkedIn profile as optimized by our team.

3. Fees, Payment, and Cancellation

3.1. Plan Structure (Applicable Fees)

• Subscription Plans (Premium, Elite, Multinational): Require a monthly payment and may require an upfront setup fee (Elite: $450; Multinational: $995).
• Success-Based Plan: Requires a one-time upfront $100 setup fee. Post-placement payments only begin 30 days after your new job start date.
• Post-Placement Fees (Success-Based):
  • For jobs secured within our direct network, employers cover all fees, and there is no cost to you beyond the setup fee.
  • For jobs secured outside of our direct network, a success fee applies, equivalent to 5% of your first year's salary, payable over 5 months.
  • Your total payments for the Success-Based Plan (including the setup fee) will not exceed $6,000.

3.2. Pausing and Cancellation Policy

• The service is month-to-month with no long-term commitment. You may pause or cancel at any time by sending your request to support@mg.skillbasedmatching.com.
• Refund Eligibility (Subscription Plans): Refunds are available only within the first 30 days of service, based on the week of cancellation:
  • Week 1 (Day 1-7): 75% refund.
  • Week 2 (Day 8-14): 50% refund.
  • Week 3 (Day 15-21): 25% refund.
  • Week 4 (Day 22-30): 25% refund.
  • No refunds are provided after 30 days of service.
• Own Job Search Success (Success-Based Plan): If you find a job through your own efforts, you are not obligated to pay any post-placement success fee. The initial setup fee covers the setup and initial services provided.

4. Intellectual Property and Content

You retain all rights to the intellectual property of your content (resumes, portfolios, etc.). You grant SkillBasedMatching a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your content solely for the purpose of providing the job search service (e.g., submitting applications and creating online portfolios).

The methodology, software, templates, domains ([YourName].com for Premium/Elite/Multinational users), and proprietary systems used by SkillBasedMatching remain the exclusive property of SkillPatron Corporation.

5. Limitation of Liability and Indemnification

SkillBasedMatching shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the service. Our total liability to you for any damages shall not exceed the amount paid by you for the service in the three (3) months preceding the claim.

You agree to defend, indemnify, and hold harmless SkillBasedMatching and its parent company, SkillPatron Corporation, from and against any claims, damages, or costs arising out of your breach of these Terms or your representations made to employers.

6. Governing Law

These Terms shall be governed by the laws of the State of Texas, United States, consistent with the company address in Dallas, TX.
